THE INTERNATIONALES MUSIKFESTIVAL ZELL AM SEE

1. AREA OF VALIDITY
These general business conditions are valid for registration and participation in the Internationales Musikfestival Zell am See. By sending in the application form, the participants agree to abide by the terms and conditions of the general business.
Application is only possible online on www.musikfestivalzellamsee.at. The participant confirms with her/his application that she/he holds all exploitation and usage rights related to the recording, which he/she submits in the application form (video). The participant indemnifies the Internationales Musikfestival Zell am See and renders it free from any liability in this respect. Master classes have to be booked on www.musikfestivalzellamsee.at at the latest by 15 July 2019. Late application is possible in principle up to and including 15 August 2019, but the registration fee will be raised from € 180 to € 220. Application by post, fax or e-mail will not be accepted and not taken into consideration. Application of participants who are under the age of 18 must do so with the consent of a parent or legal guardian. Please note that in the master classes,the number of participants is limited. Participants will be allocated according to the date when they are received.
2.1. REDUCTION OR CANCELLATION OF MASTER CLASSES
If by the closing date of application, a master class does not have the minimum number of participants, the Internationales Musikfestival Zell am See reserves the right to reduce the number of teaching days. Nevertheless, all participants still receive the full number of the teaching units. The full participation and registration fee will be reimbursed if the relevant master classes are cancelled.
3. PARTICIPATION AND REGISTRATION FEES
The registration fee of € 180 (€ 220 if application is made after 15 July 2019) covers the costs of processing the application and will not be refunded if the participant cancels.
3.1 PASSIVE PARTICIPATION
Persons who are interested in the master classes of the Internationales Musikfestival Zell am See have possibility of passive participation. Passive participants may attend other master classes as listeners. This also means that they will be granted tickets to all the public concerts including the gala concert.
Passive participation: EUR 150 (no registration fee will be charged)
4. CONDITIONS OF PAYMENT
The entire course fee must be paid immediately by credit card, PayPal or direct bank transfer as soon as the application is made online.
The general business conditions of PayPal or credit card company are applicable for the form of payment. All expenses and fees for international bank transfers are to be paid by the participant and will not be covered by the Internationales Musikfestival Zell am See.
We recommendthat participants settle all enrolment formalities by the information desk of the Internationales Musikfestival Zell am See one day before the start of the master classes, which is 7 September 2019. Participants receive their identity card from the office as well as all other necessary information.
Participants who have not settled their enrolment formalities on the first day of the master classes, at the latest, will be automatically removed from the list of participants. In this case the full participation fee will not be refunded.
Participants who cannot be present for the entire master classes have to inform the Internationales Musikfestival Zell am See by sending an email to: email@example.com.
The full participation fee has to be paid even if the master classes are only partially attended.
For online application and booking of the master classes of the Internationales Musikfestival Zell am See, participants have the right to revoke the concluded contract online within fourteen days after conclusion of the contract without stating any reasons.

When written notification of withdrawal is made, it is important to state your international bank account details (including the Bank Identification Code BIC and IBAN) as well as the name of the account holder and the address of the bank. The explanation of withdrawal is not bound to any specific form.
CONSEQUENCES OF WITHDRAWAL
If a participant withdraws within 14 days from when the contract was made, all related payments will be reimbursed in full. The payment will be made within fourteen days after initial receipt of notification of withdrawal. This excludes alltransaction charges.
All refunds will be made by the same means of payment that was used for processing the initial payment. It is, however, permissible to agree explicitly on a different form of reimbursement if this does not result in charges. For technical reasons no reimbursements can be made to credit cards.
6.1. WITHDRAWAL FOR OTHER REASONS
If written notification is made after 14 days, the registration fee cannot be refunded; the participation fee will be reimbursed excluding all transaction costs.
At the end of the master classes, active participants will receive a diploma confirming their participation in the Internationales Musikfestival Zell am See.
The office of Internationales Musikfestival Zell am See may assist in arranging shared accommodation or shared hotel rooms at the wish of the prospective participants. Costs will range between € 40 and € 60 per person and per night.
If the reservation is assisted by Internationales Musikfestival Zell am See, all fees must be paid directly to the International Musikfestival Zell am See on the day of arrival. In that case only cash will be accepted. However, if participants wish to pay earlier than the day of arrival, 7September 2019, they may do so by direct bank transfer:

The Internationales Musikfestival Zell am See assumes absolutely no kind of guarantee or liability.
8. DATA PROTECTION
The Internationales Musikfestival Zell am See gathers personal data from participants to process applications and participation in the Internationales Musikfestival Zell am See. The Internationales Musikfestival Zell am See abides by the regulations of the DSG (Data Protection Law) as well as the DSGVO (General Data Protection Regulation).
The Internationales Musikfestival Zell am See informs participants with the data protection declaration of the Internationales Musikfestival Zell am See in the processing of online application for the master classes.
9. GRANTING OF RIGHTS
All events of the Internationales Musikfestival Zell am See may be recorded by the Internationales Musikfestival Zell am See and/or authorized third parties.
The recordings can be used for broadcasts (radio and television, including online media) in full, partially, and/or in excerpts, live and for later transmission, and for individual retrieval, irrespective of the kind of receiver, and made accessible to the public. Other domestic or foreign broadcasting stations can use these recordings at the samet ime or transmit them later.
The Internationales Musikfestival Zell am See also reserves the right to distribute the event or master class performances in sound and/or audio-visual form and may have them distributed by third parties, on analogue and/or digital sound/picture/ picture-sound media, including online platforms, irrespective of existing and future format or procedure.
Furthermore, participants of the Internationales Musikfestival Zell am See explicitly declare their willingness to take part, free of charge, in recordings for documentation, current news reports and promotion for the Internationales Musikfestival Zell am See and thereby renounce all related rights.
Participants in the Internationales Musikfestival Zell am See agree that they can be photographed in the context of the Internationales Musikfestival Zell am See and that these photographs can be used with no limitations by the Internationales Musikfestival Zell am See as by sponsors of the performance and with no further compensation for usage in publications as well as for press and public related services.
By registering for the Internationales Musikfestival Zell am See, participants agree to the recording, publication and archiving of the above mentioned reports, as well as to the related renunciation of rights. Participants have no right to claim remuneration.
Participation in the Internationales Musikfestival Zell am See occurs at the participant’s own risk. Participants are liable for damages which may be incurred during the festival.
All participants of the Internationales Musikfestival Zell am See must have health, accident and liability insurance. In the case of accidents or theft of any kind, damage or loss of personal objects of the participants, the Internationales Musikfestival Zell am See assumes no liability whatsoever.
12. SPECIAL CONDITIONS FOR PARTICIPANTS WHO ARE UNDER AGE
The parent or legal guardian who concludes the contract on behalf of the participant who is under age has to sign a declaration form which the festival will provide upon processing the application forms.
The International Music Festival Zell am See cannot assume any responsibility for supervising participants who are under age. This applies to all responsibilities delineated from 7 September 2019 until 15 September 2019.
The parent or legal guardian is responsible for any damages caused by the participants who are under age. Furthermore, the parent or legal guardian indemnifies the Internationales Musikfestival Zell am See concerning all claims to compensation which are asserted by the participants who are under age.
13. APPLICABLE LAW AND PLACE OF JURISDICTION
It is agreed that Austrian law applies for all conflicts resulting from or relating to the business relationship under exclusion of norms of international private law and of the UN Convention on Contracts for the international sale of goods.
The place of jurisdiction for all conflicts resulting from or relating to the business relationship is the relevant court in the city of Vienna, Austria.
